Florida is a big state both in terms of population and geographical size. It has over 21 million residents, making it the third-most populated state in the U.S. Even though it is a large state geographically, it ranks 8th in population density, and most of the population is crammed into a handful of urban hubs, including Miami, Jacksonville, Tampa, and Orlando.

Given the size of Florida’s population, it is hardly surprising that the state sees a lot of car accidents and injuries. In 2023, there were a total of 394,456 police-reported vehicle accidents in the state. Nearly 3,500 people were killed in Florida car accidents last year and over 250,000 people were physically injured.

As a victim of personal injury seeking compensation in Florida, it is natural to want to understand the potential range of settlement payouts for your case.  So this page analyzes Florida settlement statistics and how similar cases have been resolved in the state, offering settlement statistics and examples of settlements and jury awards to help you gauge the potential value of your claim.

But.. approach settlement statistics and sample settlements with caution. No cases are identical, even when they feel identical.   The factors driving the settlement payout of a case may not always be apparent in a case summary. Comparing cases and statistics can absolutely provide valuable information about the potential value of your claim – that is why we are providing example Florida settlement amounts and jury payouts for you.  Still, you need to consult a Florida personal injury attorney who can fit your case to all the variables to determine the range of your expected settlement payout range.

We also provide a detailed summary of the Florida personal injury law you need to know to better understand the rules governing your injury or wrongful death claim.

On this page, our car accident lawyers will look at Miami auto accident lawsuits. We will review key points of Florida law relevant to auto tort cases and we will discuss how much settlement compensation plaintiffs typically get in Miami car accident cases.

I think it is useful to write about jury verdicts and give thoughts as to why I think the jury found as they did and the issues that arose in the case.  Why?  Because people are looking online for information about the value of their cases. So we summarize one case, Mayrink v. Luchsinger, the long way and then give sample settlements and verdicts in more Florida disc injury cases. On our website, we provide a ton of verdict information for victims, many of whom suffered a herniated disc.  This helps give some lens to the value of a case.  But it hardly tells the real story of the claim and why a jury may have valued it how they did.  So hopefully posts like this help educate those looking for answers.

Facts of Mayrink v. Luchsinger

This is a herniated disc case.  The plaintiff, a painter by trade, crashed into a median strip after being pushed off the road by the defendant who must have changed lanes without looking.   Usually, in these lane change cases, you almost invariably have a liability fight on your hands.  Defense counsel in this case, probably wisely, admitted responsibility.  Why is this wise?  Defense counsel often admits liability because they know if they fight and lose there is real credibility lost on the scope of the injuries battle.   By admitting fault, the defendant seems more credible and honest than if they fight on liability and lose.  Continue reading

A medical malpractice lawsuit on behalf of a Florida veteran will begin this week against the Miami Veterans’ Administration hospital. In the lawsuit, the plaintiff claims he contracted hepatitis C from an unclean medical device used in a 2007 colonoscopy. This may be the bellwether trial on this issue: there are a dozen similar lawsuits that have been filed in Florida and more have been filed in Tennessee. (Certainly, Tennessee – even with their new malpractice restrictions – is a more hospitable place than Florida for medical malpractice lawsuits.)
