Our lawyers are handling Paraquat lawsuits in all 50 states.  This page is about projected Paraquat settlement payouts for a viable Paraquat lawsuit.

People who have developed Parkinson’s disease from Paraquat want to better understand the range of settlement amounts they can expect in their Paraquat lawsuit.

It is early in the Paraquat litigation. We have had a trial.  Settlement compensation payouts are still speculative. But we can look at other similar injuries to get a settlement range if plaintiffs’ lawyers are successful, as expected, in this litigation.

Paraquat is a commercial-grade herbicide used in the agriculture industry. Over the last decade, new scientific research has shown that frequent use or exposure to Paraquat can increase the risk of Parkinson’s disease. This discovery has prompted thousands of Paraquat lawsuits by individuals who used or were around Paraquat in an occupation setting and subsequently developed Parkinson’s disease.

The Paraquat lawsuits were consolidated into a class action MDL in the Southern District of Illinois (In re: Paraquat Prod. Liab. Lit.3:21-MD-3004).  The Paraquat MDL is now heading into its 3rd year and 2024 could potentially be a pivotal year for this mass tort. The first bellwether test trial is supposed to happen in September and there is a possibility that a global settlement could get finalized before or shortly after that. In this post, we will look at what has been happening in the Paraquat lawsuits and provide our best guess as to when we could expect a global settlement.

About the Paraquat Lawsuits

Paraquat is a heavy-duty herbicide widely used in commercial farming in the U.S. for decades. Recent scientific research has shown that chronic exposure to Paraquat can significantly increase the risk of developing Parkinson’s disease.

The emergence of this evidence has led to thousands of former farmers filing Paraquat lawsuits alleging that their occupational exposure to the herbicide caused them to develop Parkinson’s disease.

The Paraquat product liability lawsuits have been consolidated into a class action MDL that has been ongoing for the last two years. In this post, we will look back at how the Paraquat litigation unfolded, the current status of this ongoing mass tort, and what to expect from the Paraquat litigation in 2023.

I take a deep dive into a recently filed Paraquat lawsuit so you better understand the foundation of these Syngenta Parkinson’s disease claims.  Our lawyers are handling these Paraquat lawsuits in all 50 states.

Paraquat is a highly toxic and poisonous chemical that is banned in over 32 countries. It is also one of the most widely used herbicides in the U.S. agriculture industry.

Recent studies have linked paraquat exposure to early-onset Parkinson’s disease, leading to a wave of Paraquat lawsuits against the companies who make the chemical. In this post, our lawyers take a detailed look at a recent Paraquat Parkinson’s disease lawsuit (Barbara Kelly v. Syngenta Crop Protection, et al., S.D. Ill., Case No. 3:21-pq-1415) by deconstructing the allegations in the Complaint.

Earlier this week, the Paraquat MDL judge (Hon. Nancy Rosenstengel) partially granted motions to dismiss filed by the defendants. Despite getting some of the plaintiffs’ minor claims dismissed, the decision was a defeat for the defense. Judge Rosenstengel flatly rejected the defendants’ primary argument that many of the plaintiffs’ claims should be time-barred under the applicable state statutes of repose.

So far enough Paraquat lawsuits have been filed that the Judicial Panel on Multidistrict Litigation (JPML) is expected to create a new class action Paraquat MDL.

Meanwhile, however, one of the earliest Paraquat Parkinson’s lawsuits is going to trial in state court in Illinois. The case, Thomas Hoffman, et al. v. Syngenta Crop Protection LLC, et al., (Case No. 17-L-517), was originally filed back in 2017 in the 20th Judicial Circuit Court for St. Clair County, Illinois.
