Sexual Assaults by Lyft Drivers

Rideshare companies like Lyft and Uber have replaced taxis as the primary form of private, for-hire transportation over the last decade. Millions of people use Lyft regularly.

Over the last few years, Lyft and Uber have been facing a growing wave of complaints, news stories, and civil lawsuits involving allegations that rideshare passengers were sexually assaulted by their driver.  The scenario usually involves a Lyft driver taking advantage of a passenger who is heavily intoxicated, and the acts of sexual assault can range from unwanted touching or groping to forcible rape and kidnapping.

Lyft receives thousands of complaints every year regarding alleged sexual assaults of passengers by Lyft drivers. According to Lyft’s own internal safety report, it receives approximately 5,000 reports of sexual assault annually. Most complaints involve inappropriate touching, but there are also numerous more serious incidents.

Allegations in Lyft Driver Sex Assault Lawsuits

A growing number of these Lyft driver sexual assault incidents have resulted in civil lawsuits naming Lyft as the defendant. These lawsuits attempt to hold Lyft liable for the sexual assault on the grounds that Lyft has been negligent in failing to conduct appropriate background checks on drivers, failing to investigate complaints about driver misconduct, and failing to properly supervise drivers, including the use of reasonable safety features like security cameras in vehicles.

The lawsuits allege that, like Uber, Lyft has been under intense pressure to hire more drivers to meet the growing demand for rideshare services in recent years. To keep up with this demand, the lawsuit claim that Lyft neglected to implement proper background screening procedures for its drivers. The lack of background screening and the fast-track driver sign-up have allegedly resulted in too many sexual predators working as Lyft drivers.

Among other shortcomings, the lawsuits claim that Lyft did not do fingerprinting of potential drivers. Lyft has also been accused of negligently failing to properly train new drivers and failing to properly supervise its drivers in the field.

Another major allegation against Lyft is that it failed to take complaints about driver misconduct seriously and often did not conduct any sort of investigation into these complaints. The lawsuits claim that if Lyft had investigated complaints properly, it would have led to the termination of many drivers who later went on to sexually assault passengers.

Uber and Lyft Sex Assault Class Action

Lyft’s primary competitor, Uber, has faced an even larger number of civil lawsuits attempting to hold the company liable for negligently failing to protect passengers from sexual assaults by its drivers. The Uber driver sex assault lawsuits have been consolidated into a class action MDL (Multidistrict Litigation) in the Northern District of California.

Uber driver sex assault MDL has been going on for over a year now. The MDL currently has over 1,400 individual plaintiffs with pending cases. These cases are going through a phase of consolidated discovery. Once this discovery phase is completed, a handful of cases will be selected for bellwether test trials.

The most likely scenario, however, is that the Uber sex assault MDL will end in a global settlement before we get to any test trials.

Why are we talking about Uber on a page looking at Lyft lawsuits?  The reason is that there is no question that the ultimately Uber settlements (and pretrial and trial rulings) will be a marker for what happens in the Lyft MDL.

We Now Have A Lyft sexual assault MDL.

And we now have a Lyft MDL.  All Lyft sexual assault lawsuits filed in federal court will be centralized before one judge in the Northern District of California. This consolidation is called a multidistrict litigation, or MDL. The lawsuits share common allegations that Lyft failed to protect passengers from sexual assault by drivers, including claims about weak background checks, lack of in-car safety measures, and inadequate training and oversight.

The goal of the MDL is efficiency and consistency. Instead of dozens of courts around the country separately handling the same discovery fights and pretrial motions, one judge oversees those issues in a single courtroom. That judge may also schedule bellwether trials, which act as test cases to show how juries respond to the evidence. If the cases do not resolve through settlement, they are sent back to their original courts for individual trials.

Why this is an MDL and not a class action lawsuit

A class action is like a bus. Everyone gets on together, travels the same route, and arrives at the same destination with the same outcome. That works when everyone was harmed in essentially the same way and damages are similar.

An MDL is more like an airport hub. Everyone passes through the same terminal for security and coordination, but each passenger still boards their own flight and goes to a different destination. The cases move together during pretrial proceedings, but each survivor’s claim remains individual, with its own facts, damages, and outcome.

Sexual assault lawsuit never fit the class action model. Each survivor’s experience is so very different. The circumstances of the assault, the level of harm, the trauma, and the long-term impact all vary. An MDL allows survivors to benefit from shared evidence and coordinated litigation while still preserving their individual right to prove their own case and recover damages based on what happened to them personally.

That is why the court chose an MDL here. It balances efficiency with fairness, without flattening deeply personal claims into a one-size-fits-all result..

Lyft Sexual Assault Lawsuit Settlement Amounts

Most of the Lyft driver sex assault lawsuits that have been filed across the country have been resolved by settlement. The terms and compensation payouts in these settlements have been confidential, so we do not know how much Lyft has been paying to resolve these claims. There have been some publicly reported settlements and verdicts, but these are only a small fraction of the total number of cases.

We can make predictions about the potential settlement value of Lyft driver sex assault cases, based on various known factors. So let’s assume we have an MDL?   What do we think the numbers will look like?

Most large personal injury MDLs end with a global settlement in which the defendant funds a program to resolve the inventory of cases. Individual claims are then evaluated using a tier or points system that weighs the severity of the assault, the strength of corroborating evidence, the venue, and the long-term harm. Higher tiers receive larger payouts than lower tiers. Settlements and Verdicts for Lyft Driver Sex Assault Cases

Here are summaries of settlements and verdicts in sexual assault cases with circumstances similar to Lyft driver assaults (and some cases actually involving Lyft drivers). These examples aim to provide insight into how similar sexual abuse lawsuits are resolved. While individual jury awards and settlement amounts offer some perspective, they have limitations as indicators of appropriate compensation.   • $400,000 Settlement (Virginia): A taxi driver drove a woman and her injured friend to a hospital. After dropping off the injured friend, the taxi driver allegedly raped the woman (an unemployed actress in her early 30s). (Not a Lyft case but same idea.)
  • $130,000 Verdict (Oregon): The plaintiff was riding in the front seat of a taxi. The driver started making unwanted sexual advances. He touched and groped her private areas without consent, forced her to touch his penis, and then attempted to kiss her. The plaintiff fought him off and fled the vehicle. Another non-Lyft case that helps demonstrate compensation amounts.  A claim like this, we think, will settle for much more in a Lyft sexual assault lawsuit, but not at the same level as a more horrific sexual assault, which we expect will often reach into seven figures.
  • $9,000,000 Settlement (Pennsylvania): Lyft and two Days Inn hotels resolved claims that an adult used Lyft to transport an 11-year-old to Philadelphia hotels, where she was raped. The complaint said three Lyft drivers completed rides even though the child did not order the trips and was visibly a minor, and it alleged Lyft failed to enforce its policy barring rides for unaccompanied minors. The case settled in November 2023 shortly before trial.

Why are there so few public numbers?  There is no Lyft MDL yet, so cases are not being consolidated in one court for bellwether trials and public rulings. Most claims resolve under confidentiality with sealed filings. Many are still in discovery. Without coordination, lawsuits are scattered across courts and often settle before a jury hears them.

But the lack of known settlements does not suggest that these claims are not strong.  Settlement payouts are determined in private negotiations that follow the strength of your proof, the venue, and the verdict risk Lyft sees once corporate documents and witnesses are on the record.
