Big news since our last Nexium lawsuit update. Last week, more than 1,000 Neixum bone injury lawsuits were centralized in an MDL before Judge Dale S. Fischer in the U.S. District Court for the Central District of California.
The common thread of these 39 claims is that Nexium caused osteoporosis, loss of bone density and/or bone fractures. Plaintiffs also claims something worse: AstraZeneca, knew about the risks of broken bones and such, but kept it to themselves to sell more Nexium.
The defendants’ big argument fighting the MDL is that that the product identification issues are unwieldy in the Nexium cases, making an MDL inappropriate. The court disagreed that this was a substantial impediment, even if true, and said there are also factual discovery issues in mass tort cases in the MDL.
