Lipitor Class Action Lawsuit Will Have to Wait

A group of Plaintiffs have filed a motion to consolidate all federal Lipitor diabetes lawsuits before one South Carolina judge as part of a Multi-District Litigation or MDL. To date, at least five different Lipitor lawsuits have been filed against Pfizer in three different U.S. District Courts throughout the country. The motion indicates that numerous additional complaints are expected.

Establishing an MDL helps to prevent duplicative discovery, avoid conflicting rulings from different judges, and helps to serve the convenience of the witnesses, parties, and the courts.

We have told you that Lipitor has been linked to diabetes. Lipitor prevents an enzyme in the liver from creating low density lipids (LDLs). The drug works to prevent the production of LDLs, a type of cholesterol that blocks arteries, and reduce the user’s risk of developing heart disease. Lipitor, which generates more than $14.5 billion in combined annual sales, is among the best selling drugs in the world.

A growing number of women are filing complaints alleging that Pfizer withheld information about the potential diabetes side effects. In February 2012, Pfizer updated the Lipitor warning label, adding information about the potential diabetes side effect to the “Warnings and Precautions” section, even though it appears that the risk may have been known for some time. As a result of complications associated with diabetes from Lipitor, plaintiffs have also indicated that they now face an increased risk of heart disease, blindness, neuropathy, kidney disease, and other health problems.

Oral arguments over the consolidation of the Lipitor diabetes litigation is scheduled for an upcoming hearing session on July 25th in Portland, Maine.
