A federal judge shot down lawyer Larry Klayman’s $1 billion lawsuit against Facebook. Klayman accused Facebook of putting him and other Jews in danger because they did not immediately take down a Facebook page calling for violence against Jewish people.
The court granted Facebook’ s motion to dismiss, ruling that under the federal Communications Decency Act of 1996 and the trees worth of case law that has followed, Facebook is not liable for speech or information posted by third parties on its site. Klayman plans to appeal.
Man, we have a lot of lawsuits against Facebook. Can we all agree that most of them are garbage? This claim was filed by a lawyer who has a history of filing lawsuits… and dealing with his own legal problems.
What do we do about this kind of stuff? Honestly, the answer is one that people really don’t want to hear: not much.
By the way, I think Facebook should take this kind of stuff down. Not because the law requires it – it does not and should not – but because it is the right thing to do.
